Davao Light and Power Company is nearing complete control of the power distribution assets of Northern Davao Electric Cooperative (NORDECO) in Tagum City and several municipalities in Davao del Norte following the issuance of a Supplemental Writ of Possession by the Regional Trial Court (RTC) Branch 2 in Tagum City on May 15, 2026.
In a statement issued on May 20, Davao Light said the court order covers the remaining distribution facilities still managed by NORDECO, allowing the utility provider to fully enforce Republic Act No. 12144.
The company said the court authorized Davao Light to take possession and operational control of all distribution assets previously operated by NORDECO within the affected areas. It added that the court sheriff has already served a Notice to Vacate to the cooperative after the order was released.
With the supplemental writ in effect, Davao Light said it is now positioned to fully deliver electric services in Tagum City and the municipalities of Asuncion, San Isidro, Kapalong, Talaingod, and New Corella.
The utility firm also cited an earlier Supreme Court ruling that upheld the constitutionality of Republic Act No. 12144, which expanded Davao Light’s franchise coverage to parts of Davao del Norte.
Davao Light assured consumers that efforts are underway to ensure a smooth transition and uninterrupted power services during the turnover process. The company likewise urged NORDECO officials to cooperate in safeguarding field personnel and maintaining stable electricity distribution.
Meanwhile, NORDECO said it will continue seeking legal remedies following the latest court action.
In a separate statement dated May 21, the cooperative disclosed that it filed a Motion for Clarification and Reconsideration before the Supreme Court concerning its recent resolution on the franchise dispute.
NORDECO said the motion aims to seek further clarification and a more comprehensive review of the legal issues surrounding the case. The cooperative also maintained that litigation before the RTC remains pending, particularly on matters involving the original Writ of Possession.
The cooperative added that it will continue to pursue all available legal remedies related to the Supplemental Writs of Possession.
NORDECO emphasized that its actions are anchored on constitutional procedures and the rule of law, while reaffirming its commitment to transparency and accountability to its member-consumer-owners.
